By accessing our website, making a payment, requesting a quotation, or engaging our services, you agree to the terms outlined below. These Terms of Use apply to clients, website visitors, and users of Tricore's services.

All work is performed according to the agreed project scope, proposal, quotation, statement of work, or written communication between Tricore and the client.

Project Onboarding & Communication

A project begins after the required initial payment has been received and the project scope and requirements have been clearly defined and agreed upon.

Clients agree to:

  • Provide required content, information, assets, credentials, and access on time.
  • Provide timely feedback, approvals, and decisions.
  • Review project work and communicate required changes promptly.
  • Communicate through the channels mutually agreed upon.
  • Provide accurate and complete project requirements.

Delays in providing required information, content, approvals, credentials, or feedback may affect the project timeline and delivery schedule.

Payments & Billing

Payments must be made according to the milestones, payment schedule, or billing terms agreed upon in the applicable proposal, quotation, invoice, or service agreement.

Depending on the project, payments may include:

  • Initial or advance payments
  • Milestone-based payments
  • Hourly or time-based billing
  • Monthly maintenance or support fees
  • Recurring service charges
  • Third-party software, hosting, app, plugin, or subscription costs

Invoices must be paid on or before the due date specified in the invoice or applicable agreement.

Payment Processing

Payments made through Razorpay, bank transfer, or any other accepted payment method are considered confirmed once successfully processed. Applicable taxes, payment processing charges, and third-party transaction fees may be payable by the client where applicable.

In case of overdue payments, Tricore may temporarily suspend project work or services until outstanding amounts are cleared, subject to the applicable agreement.

Cancellation & Refund Policy

A client may request cancellation of a project by providing written notice to Tricore. However:

  • Payments are generally non-refundable once project work has commenced.
  • If cancellation is requested before work begins, a partial refund may be considered after deducting applicable administrative, planning, consultation, or preparation costs.
  • Payment gateway and transaction charges are non-refundable.
  • Any refund will be subject to the applicable proposal, agreement, or project terms.
  • Work already completed before cancellation may be charged accordingly.

Tricore aims to handle cancellations and refunds fairly and transparently while protecting the interests of both parties.

Intellectual Property & Ownership

Unless otherwise agreed in writing, designs, source code, graphics, documentation, and other project deliverables created specifically for the client remain the property of Tricore until all outstanding payments relating to the project have been received.

After Full Payment

  • Final project deliverables created specifically for the client will be transferred to the client as agreed in the applicable project agreement.
  • Third-party themes, plugins, applications, libraries, stock images, fonts, software, and other third-party materials remain subject to their respective licenses and terms.
  • Tricore retains ownership of its pre-existing tools, frameworks, libraries, reusable components, methodologies, know-how, and technologies that were not created exclusively for the client.

Tricore may showcase completed, non-confidential projects in its portfolio, website, presentations, or marketing materials unless the client requests otherwise in writing.

Confidentiality

Both Tricore and the client agree to maintain reasonable confidentiality regarding confidential business information, project information, documents, credentials, technical information, and other sensitive information shared during the course of a project.

Tricore will take reasonable measures to protect client information and restrict access to authorized personnel and service providers who need the information to perform the agreed services.

Where required, the parties may enter into a separate Non-Disclosure Agreement (NDA), which will govern the confidentiality obligations covered by that agreement.

Third-Party Services & Tools

Some projects may require third-party services, including:

  • Shopify or other e-commerce platforms
  • WordPress themes and plugins
  • Apps and extensions
  • Hosting services
  • Domain services
  • Payment gateways
  • APIs
  • Cloud services
  • Software subscriptions
  • Stock assets and licensed resources

Unless otherwise agreed, the purchase, subscription, renewal, and ongoing billing of third-party services are the client's responsibility. Tricore may assist with setup, configuration, integration, or troubleshooting where included in the project scope.

Tricore is not responsible for changes, price increases, limitations, suspension, security issues, downtime, or service failures caused by third-party providers.

Quality Assurance & Support

Tricore makes reasonable efforts to test project work before delivery. Any bugs or defects reported within the agreed support or warranty period will be reviewed and, where applicable, corrected at no additional cost if they:

  • Relate to the original project scope; and
  • Result from the work delivered by Tricore.

Requests for new features, changes in requirements, additional functionality, redesigns, or work outside the original scope will be treated as additional work and may be billed separately.

Website Use

You agree to use the Tricore website only for lawful purposes. You must not:

  • Attempt to gain unauthorized access to our systems.
  • Introduce viruses, malware, or harmful code.
  • Interfere with the operation or security of the website.
  • Copy or commercially exploit website content without permission.
  • Use automated tools to scrape or collect website content without authorization.
  • Submit fraudulent, misleading, or unlawful information.
  • Infringe the intellectual property or other rights of Tricore or third parties.

We make reasonable efforts to ensure that information published on our website is accurate and current. However, we do not guarantee that all content will always be complete, accurate, or up to date.

Limitation of Liability

To the maximum extent permitted by applicable law, Tricore InfoTech Pvt. Ltd. will not be responsible for indirect, incidental, special, or consequential losses arising from the use of our website or services. This may include:

  • Loss of business

  • Loss of business opportunities
  • Business interruption
  • Third-party system failures
  • Hosting or infrastructure issues
  • Third-party software or service failures
  • Technical limitations outside our reasonable control

To the extent permitted by applicable law and subject to the applicable agreement, Tricore's total liability relating to a specific service will generally be limited to the amount actually paid to Tricore for that specific service.

Nothing in these Terms limits any liability that cannot legally be limited or excluded.

Subject to applicable law and any separate written agreement between Tricore and the client, disputes relating to these Terms or our services will be subject to the jurisdiction of the competent courts in Ahmedabad, Gujarat, India.
